Understanding Break and Enter Charges
Break and enter charges are often laid when a person enters or trespasses onto private property—such as a home, apartment, garage, or place of business—with the intent to commit a criminal offence inside. You do not have to break a window, force a lock, or even damage anything to be charged. Simply walking through an unlocked door, if done with criminal intent, can result in a break and enter charge.
The law does not require theft or actual property damage to occur. A charge can be laid even if no items were taken or no harm was done.
The most serious form of break and enter involves residential properties—especially when someone is home at the time of the alleged offence. If there’s evidence that the person knew someone was present and was prepared to use force, the Crown may treat the case as a home invasion. These cases carry some of the harshest penalties under the law and are often prosecuted aggressively due to the potential threat to personal safety and privacy.
